1. Acceptance of the Terms
Welcome to Advit Care Academy ("we," "us," "our," or the "Academy"). These Terms of Use ("Terms") govern your access to and use of our websites, applications, learning platforms, content, and all related services (collectively, our "Services").
By accessing or using our Services, creating an account, or enrolling in our programs, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
For Students Under the Age of 18 ("Minors"): If you are a Minor, you may only use the Services with the involvement, supervision, and consent of a parent or legal guardian. Your parent or legal guardian must agree to be bound by these Terms on your behalf.
For Parents and Guardians: By creating an account for or permitting your child to use the Services, you represent that you are the parent or legal guardian of the student, and you agree to be bound by these Terms on behalf of yourself and your student. You are fully responsible for their use of the Services and their compliance with these Terms.
For Adult Learners (18 and Over): If you are 18 years of age or older, you agree to these Terms on your own behalf.
2. Description of Services
AdvitCare Academy provides a wide range of online educational services, including but not limited to K-12 curriculum, tutoring, certificate programs, diploma programs, and higher education and college-level courses designed for learners of all ages.
3. User Accounts and Registration
Account Creation: To access most features of the Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information.
Account Responsibility: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
Account Types:
Parent/Guardian Accounts: Parents or legal guardians must create and manage the primary account for any enrolled Minor.
Student Accounts: Accounts for Minors are linked to a Parent/Guardian Account. Adult learners manage their own accounts.
One Account Per User: Each individual user (student, parent, or instructor) is limited to one account.
4. User Conduct and Academic Integrity
All users of our Services are expected to adhere to a code of conduct that promotes a safe, respectful, and effective learning environment.
You agree not to:
Use the Services for any illegal or unauthorized purpose.
Harass, bully, intimidate, or threaten any other user, instructor, or staff member.
Post or transmit any content that is defamatory, obscene, pornographic, vulgar, or offensive.
Share your account credentials or allow anyone other than the registered user to access your account.
Attempt to gain unauthorized access to our systems or another user's account.
Upload or transmit any viruses, worms, or other malicious code.
Academic Integrity: All students, regardless of age or level of study, are expected to uphold the highest standards of academic honesty. Prohibited actions include, but are not limited to:
Plagiarism: Submitting work that is not your own without proper citation.
Cheating: Using unauthorized materials or assistance on assignments, quizzes, or exams.
Misrepresentation: Falsifying information or having another person complete your coursework.
Unauthorized Collaboration: Working with others on assignments when it is not explicitly permitted.
Violations of the academic integrity policy may result in penalties ranging from a failing grade on an assignment to suspension or expulsion from the Academy, at our sole discretion.
5. Intellectual Property Rights
Our Content: All content provided through the Services, including curriculum, text, graphics, logos, videos, and software, is the property of Advit Care Academy or our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial educational purposes only.
User-Generated Content: If you submit, upload, or post content (such as assignments, projects, or forum posts) to the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content in connection with providing and promoting the Services. You retain all ownership rights to your content.
6. Payments, Fees, and Subscriptions
For any paid Services, you agree to pay all applicable fees as described on our website. All fees are non-refundable, except as required by law or as explicitly stated in our refund policy. You are responsible for providing accurate and current payment information.
7. Termination
By You: You may terminate your account at any time by contacting our support team.
By Us: We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for any conduct that we believe violates these Terms, is harmful to other users, or is otherwise disruptive to the educational environment.
8. Disclaimer of Warranties and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, ADVIT CARE ACADEMY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL ADVITCARE ACADEMY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICES IS LIMITED TO THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE LAST TWELVE MONTHS.
9. Indemnification
You agree to indemnify, defend, and hold harmless AdvitCare Academy and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Services.
10. Governing Law and Dispute Resolution
